The Terre des hommes Regional Office for Central and South Eastern Europe in Budapest is seeking an international researcher for the development of a regional comparative report within its “PRO-JUS - Procedural Rights of Juveniles Suspected or Accused in the EU” project.

The regional comparative report is to be based on the developed national reports for 5 countries (Belgium, France, Hungary, Spain and The Netherlands) and which were articulated around already conducted: i.) thorough desk research on the domestic legislation and its compliance with the three EU directives mentioned above; and ii.) national analyses of the empirical evidence and data collected during 6 months in the 5 countries mentioned above.

Based on the national reports that he/she will receive from the project coordinator, the successful candidate will conduct a comparative analysis of the situation of foreign children suspected or accused in criminal proceedings and how their procedural rights are effectively enforced in Europe. The international researcher is expected to produce a regional report (50 pages) focusing on the best practices that the research will have contributed to identify. Following the development of the regional comparative report, the project envisages the development of a handbook for legal practitioners with the aim to assist legal representatives of suspected or accused foreign children in upholding the rights of their vulnerable clients. The regional comparative report will lay down the basis for the development of the handbook.

Expected Results:

Regional Comparative Report in English

  1. A regional research report on the situation of foreign children suspected or accused in criminal proceedings in Europe is produced and highlights best practices identified in the 5 countries and beyond
  2. The regional research report provides a critical analysis and allows a better understanding of the following aspects:
    1. Vulnerability of foreign children suspected or accused in criminal proceedings.
    2. Views of foreign children of the judicial treatment of their case
    3. Adequacy and effectiveness of available mechanisms to ensure the procedural rights of foreign children suspected or accused in criminal proceedings are respected
    4. Structural hindrances that hamper foreign children to access their procedural rights in criminal proceedings
  3. A set of recommendations on the ways to ensure the rights of foreign children suspected or accused in criminal proceedings is provided

Starting date of the assignment: 15 July 2016

Required/preferred experience and skills of the researcher:

  • Master’s degree in Law, EU Law or Human Rights Law followed by a minimum of 8 years of experience in research in a similar field (PhD and specialization on children’s rights, juvenile justice or criminal procedure a strong advantage),
  • Minimum of 8 years of experience in conducting quantitative and qualitative research in a relevant field (Criminal Law, Juvenile Justice); Experience in supervising a team of experienced researchers a strong asset.
  • Expertise in working and consulting with children in similar research an advantage;
  • Knowledge on Child Rights and Child protection concepts;
  • Very good understanding of ethical considerations in conducting research work with children;
  • Excellent analytical and report writing skills;
  • Ability to work under time constraints;
  • Outstanding level of English.
